These Terms and Conditions, and the related Forms and web pages they reference, constitute a legal Agreement between You the end user and Hong Kong uCloudlink Network Technology Limited or its affiliate who is the actual service provider (“ UCLOUDLINK”).
COMPLIANCE WITH APPLICABLE LAWS
By entering into this Agreement You expressly confirm that You are legally entitled to enter this Agreement.
UCLOUDLINK shall make every effort to provide a high level of availability for its GlocalMe Service. However, UCLOUDLINK is unable to guarantee continuous, fault-free operation of its mobile data Service or certain transmission times or capacities. UCLOUDLINK reserves the right to service its mobile data Service at any time, which may result in temporary disruptions. No representations or guarantees are made in respect of availability, quality, operation or support for data communication on third-party networks. No guarantee may be given for absolute protection of UCLOUDLINK's Service against unauthorized access or interception. UCLOUDLINK shall assume no liability for any such occurrence. UCLOUDLINK may at any time adapt or interrupt its services. UCLOUDLINK may engage at any time a third party to fulfil any of its obligations under this contract.
You will be charged UCLOUDLINK's standard rate for the Services unless agreed in writing with UCLOUDLINK. The UCLOUDLINK Service operates on a pre-pay basis and you will be prompted to pay these rates in advance. A full list of UCLOUDLINK's rates for standard Services is published at www.glocalme.com. These rates may be changed from time to time, entirely at UCLOUDLINK's discretion, so you should check the UCLOUDLINK website regularly to determine if any changes have been made or announced. If you have no credit in Your Account you will be unable to initiate a data session.
SUSPENSION OR TERMINATION OF SERVICES
If you need assistance regarding the GlocalMe Service, please email firstname.lastname@example.org.
If we reasonably believe the information supplied to us has been given without the knowledge of the person named or it is unauthorised or contains false particulars, we may delay, suspend or terminate your Service. Under these circumstances you will have no claim against us.
Your account will appear to be inactive if it has not been used for eighty days. You can contact us to reactive the account if you need to use it again.
You may apply for a refund under the following circumstances:
You have encountered operational issues with GlocalMe hardware while travelling. GlocalMe hardware must be returned to UCLOUDLINK. Details must be advised in writing, including examples of issues encountered. UCLOUDLINK will use its discretion to identify the problem. If the problem relates to GlocalMe hardware and its performance, a full refund for GlocalMe hardware and credit purchased will be awarded. Please note that the quality and coverage of roaming networks vary by country. No representations or guarantees are made in respect of availability, quality, operation or support for data communication on third-party networks or with third-party lines while roaming. If the problem relates to any other issue not related to the actual GlocalMe hardware performance, a refund will be given for the unused credit portion only. Every attempt will be made to identify the problem in order to give you the option of using the GlocalMe hardware on your next trip.To apply for a refund of your GlocalMe hardware and/or credit, please follow the below steps:1 Send a detailed letter outlining the reasons for your refund request.2 Enclose the GlocalMe hardware and send letter to the below address:

3 Allow 10 working days for refund to be processed.4 UCLOUDLINK will reply to your request with an outcome by email.5 If a refund has been approved, the amount will be credited back to the credit card or Paypal which was originally used for purchase for pre-pay.
RETURNING UNWANTED/NOT FAULTY GOODS
If for any reason you change your mind about your purchase any item may be returned within 14 days of the date of receiving your order. Your item must remain in a saleable condition with original packaging and all seals unbroken. We will refund the price of the item excluding shipping costs after we have inspected the goods and confirmed the condition of the goods as appropriate for refund. Please supply the following details otherwise the claim will not be processed:

Please send your returns in by courier or post only once you have received confirmation from UCLOUDLINK- please note that we strongly advise you to use a secure registered and tracked service. If goods are not sent by a registered and tracked service lost good will be your responsibility. The cost of returning the goods is your responsibility.
Please note that all returns will be sent to our quality department for testing. Please note if returning goods we require the original invoice. Without this information we will be unable to identify the returned package as yours and we will not be able to process the return/ refund.
Please retain proof of posting. The goods remain your responsibility until they are received by us.
RETURNING FAULTY GOODS
All devices are sold on a non-return basis and may only bereturned for credit if found to be faulty within 30 days of dispatch fromUCLOUDLINK and provided that the following conditions are fully met.
All devices must be fully boxed and in AS NEW condition.
ALL returns must be returned complete: Device, Box, Manual
UCLOUDLINK reserve the right to reject returns for credit, ifreturned goods are found not to meet these requirements, all goods will bereturned to you at your own cost and NO Credit will be issued.
All devices returned need to be classified with a reason for return.
IMEI match: - IMEI on Device and Box must match
UCLOUDLINK reserve the right to reject returns for credit anydevices where the IMEI does not match box and device or the device isdamaged or in poor condition.
Please ensure that all items are securely packaged.
All return costs will be covered by UCLOUDLINK.
Credit will only be issued upon completion of the above processand once the product has been returned back to us.
UCLOUDLINK reserves the right to reject any NFF (No FaultFound) and the unit will be returned to you at your cost.
NFF (No Fault Found) are units that when tested the reportedfault or any fault could not be reproduced.
Please note that all returns will be sent to our qualitydepartment for testing. Any device which has been used to avail ofGlocalMe services will not be accepted as a return under the DistanceSales regulations and will be returned to you within 7 working days (thisdoes not affect your statutory rights under the Sale Of Goods Acts).
Please note if returning goods we require the original invoiceor your full name and address. Without this information we will be unableto identified a returned package as yours and we will not be able toprocess the return/refund.
When re-packaging the goods, you need to ensure you haveincluded the complete set of product items (including accessories,instruction manual and/or additional items that we originally sent to you,including any free gift.
Please retain proof of posting. The goods remain yourresponsibility until they are received by us.
ASSIGNMENT OF RIGHTS
You may not assign your rights under this agreement unless expressly agreed by UCLOUDLINK. UCLOUDLINK may assign our rights under this agreement to any company that controls UCLOUDLINK or that UCLOUDLINK controls.
GlocalMe is a registered trademarks of UCLOUDLINK in Hong Kong. The GlocalMe logo and UCLOUDLINK are trademarks of UCLOUDLINK.
If you have any complaints about the service, You should send them in the first instance to email@example.com.
While we will endeavour to provide the service with minimum disruptions, we cannot guarantee a fault free Service and You agree to accept the service 'as is'. We reserve the right to suspend the service for technical, operational or other reasons. UCLOUDLINK reserves the right to withdraw this service and any additional services at its sole discretion.
THE SERVICE IS PROVIDED ON AN 'AS IS' BASIS, AND YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. UCLOUDLINK DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; MERCHANTABILITY; TITLE OR NON-INFRINGEMENT; OR ANY WARRANTY ARISING FROM ANY COURSE OF DEALING, USAGE OR TRADE PRACTICE. UCLOUDLINK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We reserve the right to make changes to these terms and conditions. You should check the UCLOUDLINK website regularly to see if any changed have been made or announced. We will endeavour to provide 30 days advance notice of significant changes, either by posting such notice on our website, or by contacting you directly. If you do not notify us within 30 days of a change then You will have been deemed to accept this change to this Agreement.
LIMITATIONS AND EXCLUSIONS OF WARRANTIES AND LIABILITY
1. Exclusions of Certain Damages
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY WHATSOEVER), SHALL UCLOUDLINK BE LIABLE FOR ANY DAMAGES YOU MAY SUFFER FROM OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, UCLOUDLINK'S NETWORK OR EQUIPMENT, OR THE SERVICE. THIS LIMITATION INCLUDES, BUT IS NOT LIMITED TO, DAMAGES RESULTING FROM LOSS OR THEFT OF DATA; TRANSMISSION DELAYS OR FAILURES; SERVICE INTERRUPTIONS; UNAUTHORIZED ACCESS OR DAMAGE TO RECORDS, SOFTWARE PROGRAMS OR OTHER INFORMATION OR PROPERTY; LOSS OF PROFITS; COST OF COVER; OR ANY OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, DIRECT, INDIRECT OR PUNITIVE DAMAGES, HOWEVER CAUSED. THIS LIMITATION WILL APPLY EVEN IF UCLOUDLINK HAS BEEN ADVISED OF, OR IS AWARE OF, THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CERTAIN FORMS OF LIABILITY, SOME OR ALL OF THE EXCLUSIONS SET FORTH IN THIS AGREEMENT MAY NOT APPLY. IF ANY OF SUCH EXCLUSIONS ARE NOT ALLOWED UNDER THE LAWS OF A PARTICULAR STATE OR OTHER JURISDICTION FOR ANY REASON, THEN UCLOUDLINK'S MAXIMUM LIABILITY FOR ANY TYPE OF DAMAGES WITH RESPECT TO UCLOUDLINK'S NETWORK, EQUIPMENT, OR SERVICES SHALL BE LIMITED TO THE AMOUNT OF MONTHLY SERVICE CHARGES PAID BY CUSTOMER TO UCLOUDLINK HEREUNDER FOR THE TWELVE (12) MONTH PERIOD PRIOR TO THE OCCURRENCE OF THE EVENT GIVING RISE TO SUCH LIABILITY.
2. Disclaimer of Third Party Actions and Control
UCLOUDLINK DOES NOT AND CANNOT CONTROL THE QUALITY OF OTHER PARTIES' NETWORKS TO WHICH UCLOUDLINK MUST INTERCONNECT. THEREFORE, UCLOUDLINK DISCLAIMS ANY AND ALL LIABILITY THAT MAY ARISE FROM THE PERFORMANCE, INCLUDING FAILURE, OF OTHER PARTIES' NETWORKS.
3. Limitation on Remedies
THE SERVICE CHARGE CREDITS LISTED IN THIS SECTION ARE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE TO YOU FOR ANY FAILURE BY UCLOUDLINK TO COMPLY WITH ITS OBLIGATIONS UNDER THIS AGREEMENT, WHETHER SUCH FAILURE RESULTS IN DOWNTIME, NETWORK CONGESTION OR OUTAGES, OR ANY OTHER SERVICE FAILURE.
These Terms and Conditions and additional terms and conditions as explicitly identified on the UCLOUDLINK website constitute the entire Agreement between You and UCLOUDLINK . Should any terms of the Agreement be declared void or unenforceable by any arbitrator or court of competent jurisdiction, such terms will be amended to achieve as nearly as possible the same economic effect as the original Agreement, and the remainder of the Agreement will remain in full force and effect.
UCLOUDLINK will not be liable for any failure to perform under this Agreement caused, directly or indirectly, by factors beyond its reasonable control, including any acts of God, earthquake, flood, embargo, riot, war, sabotage, terrorist attack, labour shortage or dispute, governmental act or failure of any third-party service or network.
CHANGES IN REGULATION
You and UCLOUDLINK understand that regulators, or other bodies of competent legal jurisdiction may impose regulations on IP-based services. If new regulations are imposed on UCLOUDLINK, UCLOUDLINK is authorized to make changes to this Agreement that reflect the new regulations, and will post such changes on its corporate website and may in addition send email/SMS notices to its customers. UCLOUDLINK retains the right to pass on to you any new regulatory fees or taxes that may be imposed by law or regulation.
If you are in China, this agreement is governed by the laws of China; if you are outside of China, this agreement is governed by the laws of Hong Kong. Should a court of competent jurisdiction find that any provision or portion of this Agreement to be unenforceable, the remainder of the terms included herein will continue with full force and effect.
Any references in the Agreement to any forms, documents or instruments shall be deemed to refer to the same in both paper and electronic form.

ADDITIONAL SERVICES, FEATURES AND TERMS
UCLOUDLINK may, from time to time, introduce additional services which you will need to sign up to on the web. These services will be covered by these terms and conditions but you may have additional terms and conditions to which you will need to agree before gaining access
We may translate the original English Language version of this Agreement into other languages. If there is any inconsistency or discrepancy between the English Language version and any other language version of this Agreement, the English language version shall prevail
FEES AND TAXES
Your goods may be subject to the customs fees and import duties of the country to which you have your order shipped. These charges are always the recipient's responsibility and are completely beyond our control.

uCloudlink may collect, store and use your information (“Personal Information”) while providing services. Personal Information refers to the information that can be used on its own or with other information to identify an individual, which will be collected when you use our products or services, including user name, date of birth, address, ID number, telephone number, email account, and when and where you use our products and services. If you do not provide the relevant information, you may not be able to register for an account and enjoy our services, as well as achieve the specific purpose for some particular service.

2.3.1 Log information: when you use our services, the system may automatically collect technical information via cookies, web beacon or other methods including:
· Device or software information, such as your mobile device, web browser or configuration information provided by other programs to access our services, your IP address, and the version and IMEI number of your mobile device; information your searched or reviewed when you use our service, such as the keyword, the webpage you visited, and other information you surfed or request to provide when you use our service.
2.3.2 Location information: when you have location feature enabled and use location-based apps, we may collect your location information, including:
· When you access our services from the location-based mobile device, we may collect your location information;
· Real-time information from you or other users, including your geographic location indicated in your account information.
2.4 Description of Cookies
2.4.1 To ensure that the site is functioning, to provide you with an easier access experience, and to recommend content that may be of interest to you, we store small data files called cookies on your computer or mobile device. Cookies often contain identifiers, site names, and some numbers and characters. With cookies, websites can store data such as your preferences or shopping baskets. You can manage or delete cookies according to your preferences. For example, the email we send to you may contain an address link to the content of our website. If you click on the link, we will track the click to help us understand your product or service preferences so that we can proactively improve customer service and experience. How uCloudlink may use Personal Information
2.5 uCloudlink will use your Personal Information based on the following legitimate purposes.
2.5.1 Provide you with services；
2.5.2 Used for authentication, security, fraud monitoring, archiving and backup purposes to ensure the security of products and services provided to you by uCloudlink;
2.5.3 Help uCloudlink improve products and services;
2.5.4 Help uCloudlink know more about your access to and use of our services to fulfill your personalized requests, such as language settings, location settings, personalized support and instruction or other aspects.
2.5.5 Participate in market research related to our products and services;
2.5.6 analyze your geographical location to provide better network coverage.
2.6 To improve user experience and our services and other purposes with your consent, to the extent permitted by law, uCloudlink may apply the information collected from specific service through aggregate or personalized methods to other services. If uCloudlink provides the relevant options in related services, you can also authorize us to access these information provided and stored.
2.7 We may use user portrait formed by your information to share with partners who provide advertisement and analysis services to improve the effective target rates of advertisement and service information without recognizing your personal identity. Unless agreed by you, we will not share your personal information with partners who provide advertisement and analysis services.
3. How uCloudlink may share, transfer, disclose your Personal Information

3.1 Except for the following circumstances, uCloudlink and its affiliates will never release your Personal Information to any third party without your consent.

3.1.2 uCloudlink or its affiliates may save, store or disclose your Personal Information for the following purposes:

5.1 uCloudlink will do its utmost to take the appropriate technical measures to ensure that you can access, update, correct and delete your own registration information or other Personal Information provided when you use our services.
5.2 you access, update, correct and delete the aforementioned information, you may be asked for authentication to protect the information security.
5.3 you can cancel your account in accordance with the provision stated in “Notes on the cancellation of uCloudlink account". After you cancel your account, your personal information will only be removed from the front system of uCloudlink's associated website and we will keep it irretrievable, accessible, or anonymized.
6. How uCloudlink protect Personal Information
6.2 uCloudlink uses various management policies (such as establishing information security system; signing a confidentiality agreements with information management employees; allowing only work-related employees to access the information collected; and other similar policies) and security techniques, procedures (such as entering passwords before access, access control isolation, monitoring for computer use, etc.) and periodical audit to prevent the loss of information, improper use, and unauthorized reading or disclosure. For example, in some services, uCloudlink uses encryption technology (such as SSL) to protect the Personal Information you provide. However, please understand that due to technical limitations and possible malicious means, it is impossible for any company providing Internet-related services to guarantee 100% security of information, even if all efforts are made to strengthen security measures. You need to understand that the systems and communication networks you use to access uCloudlink services may be subject to problems that are beyond uCloudlink’s control.
6.3 If uCloudlink is informed that the security of the data it has acquired and stored is compromised or the user's nonpublic information is disclosed to an unrelated third party due to external acts (such as hacker attack), uCloudlink will take reasonable actions (including but not limited to internal investigations, reporting and notification to law enforcement agencies, and cooperation with the law enforcement agencies) as it may consider appropriate, notwithstanding any disclaimer in this Policy. In parallel, uCloudlink will take legal and reasonable steps as it deems appropriate to notify the relevant users, informing them of the information disclosed and the extent to which we are aware of such situations.
7. Protection of minors’ Personal Information
Anyone who is identified to be a minor customer must obtain the consent and instruction from his or her parents or guardians to use our products and services.
If you are a minor, you shall obtain the agreement of your legal guardian before providing your Personal Information.
8.1.1 Information collected by third party services (the third-party websites included) through our services;
8.1.2 Information collected by other advertising companies to serve advertisements through our services;
Any notice from uCloudlink will be sent to the email address, phone number, and/or mailing address left when you register for an account or purchase of our product, or pushed directly through mobile phone system. If sent via electronic methods, notice shall be deemed served when your device or the used electronic system receives the message; if sent by courier, it shall be deemed served on the third day after sending out.

Notes on the cancellation of uCloudlink account

Before you click on the consent in the process of applying for cancellation, you should carefully read "Notes on the cancellation of uCloudlink account" (hereinafter referred to as the "Note on Cancellation").
Please be sure to read carefully and fully understand the relevant provisions of the agreement, including:
1. Terms with which you agree to exempt or limit uCloudlink’s liability;
2. Other important terms that are underlined in bold.

[Special reminder] When you complete the information, read and agree to the " Note on Cancellation" and related terms and conditions and complete the cancellation procedures after signing off according to the logout page, you have fully read, understand and accept all of this "Notice on Cancellation ". content. If you do not agree with any of the relevant terms and conditions in the process of reading this "Notice on Cancellation", please immediately stop the account cancellation process.
Dear uCloudlink users:
We hereby kindly remind you that your cancellation of your account will bring inconvenience to your post-sale rights protection. After you cancel your account, your personal information will only be removed from the front system of uCloudlink's associated website and keep it irretrievable, accessible, or anonymized.
1. If you are still determined to cancel your account, your account must meet the following conditions:
(1) the account is registered by yourself in the Glocalme official site or channels in accordance with the Glocalme user agreement and for your personal use only;
(2) In the last month, the account did not perform sensitive operations such as changing passwords, changing binding information, etc., and the account was not stolen or sealed;
(3) The account has no assets and virtual right and no amount owed in uCloudlink’s related systems;
(4) There are no unfinished orders or services in the account, and all orders have been completed for more than one year;
(5) There are no disputes in the account, including complaints or being complained;
(6) The account shall not have any rights and obligations arising or maintained as a result of the cancellation of the account in relation to the existence of the account, and the circumstances in which uCloudlink considers that the cancellation of the account would result in a dispute arising out of its outstanding rights and obligations;
(7) when applying for cancellation of an account, uCloudlink is authorized to freeze all or part of the funds in your account or account in order to continue to verify or, where necessary, to report fraud or unlawful acts to the regulatory or judicial authorities;
2. Once uCloudlink account is cancelled, it will not be restored. Please back up all information and data related to your uCloudlink account before proceeding. Please save your transaction vouchers, bills and other information for order goods and services, otherwise you may have to pay additional account and order inquiry fees, or you may not be able to enjoy after-sales service.
3. During the period of cancellation of uCloudlink accounts, if your accounts involve disputes, including but not limited to complaints, reports, lawsuits, arbitrations, and investigations by the competent authorities of the country, uCloudlink shall have the right to terminate the cancellation of your account without further consent from you.
4. By cancelling your uCloudlink account, you will no longer be able to use this account, nor will you be able to recover any content or information in your account and related to your account, including but not limited to:
(1) You will not be able to log in and use this account;
(2) The personal data and historical information of this account will not be recovered;
5. The cancellation of this account does not represent exemption or mitigation of the account conduct and related responsibilities prior to the cancellation of this account.
